Joseph A. Gallagher, 28, of Smithtown, was arrested after Swatara Township Police on Friday, Oct. 4, in Pennsylvania, after police learned Gallagher had sex with a student who was in the area for a school trip, the department said.
The former teacher had been arrested in June by Nassau County Police after school officials learned of ongoing “sexually charged text conversations” with a 16-year-old student.
According to the Swatara police, the two met in Pennsylvania, between May 17 and May 19, while the student was on a school trip to Hersey.
After being caught, the teen allegedly told police that she waited until all the students in her room were asleep before leaving to meet up with the Gallagher. But one student saw the teen leave the room and reported it to authorities, according to court documents.
Gallagher was charged with intercourse/sexual contact with a student, unlawful contact with a minor/sexual offenses, disseminating explicit sexual material with a minor and unlawful contact with minor/obscene, corruption of a minor, and other sexual materials and performances.
